PA Republicans Appeal to SCOTUS over Provisional Ballots
Washington D.C. – Some Pennsylvania Republicans have asked the Supreme Court of the United States to block the counting of potentially thousands of provisional votes next week. On Monday, the same defendants who lost a battle to prevent voters whose mail-in ballots were invalidated because of mistakes or missing privacy envelopes from casting provisional ballots appealed to SCOTUS for a decision. They are asking for the Supreme Court to halt the counting of those ballots on Tuesday, or at least require that the provisional votes be set aside uncounted until the legal battle plays out in federal court.
Last week in a 4-3 decision, the Pennsylvania Supreme Court ruled against Butler County and the Pennsylvania Republican Party’s assertion that voters whose mail-in ballots are voided should not be allowed to cast a provisional ballot in person. The court battle began in Butler County when two residents who had failed to put their ballots for the April primary in the security envelopes also had their provisional ballots rejected by the Butler County Board of Elections; the ACLU and The Public Interest Law Firm represent the plaintiffs. Mail-in ballots can be voided for a number of technical reasons, including lack of a signature, lack of a security envelope, improper dates, and more; the Pennsylvania Republican Party claims that allowing someone to cast a provisional ballot after the rejection of their mail ballot is allowing them to vote twice.
